TCPA + state-by-state SMS rules

A few compliance points to know:
  • TCPA (federal). Sending an SMS to a phone number that just called you generally falls under "established business relationship" exemptions. The system includes opt-out language ("Reply STOP to opt out") in the first message and respects opt-outs across the system thereafter.
  • State-by-state SMS regulations. Some states have stricter SMS regulations on top of TCPA. The system flags state-by-state quirks and lets you configure tighter posture per market.
  • Opt-out enforcement. Once a customer replies "STOP" or any standard opt-out, the system blocks all future automated SMS to that number.
  • Recordings of voice calls that triggered the SMS are stored per your retention policy. Useful as evidence of established business relationship if a TCPA dispute arises.
